HIPAA Statement
SCIO Health Analytics complies with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and any guidance provided by the U.S. Department of Health and Human Services. SCIO Health Analytics has implemented safeguards to ensure the protection of Protected Health Information ("PHI"). Safeguards include various protections such as administrative procedures; physical data safeguards; electronic data access security; and network security that comply with legal requirements, are currently being used to ensure the protection of private health information.
SCIO Health Analytics may use or disclose PHI for the purpose of investigating and pursing the subrogation and/or reimbursement of client's subrogation and/or reimbursement claim or interest, coordination of benefits, claims management, underwriting, actuarial support, membership and provider management, disease management and care management support. The reason for such use and disclosure of PHI is such that providing services of these kinds often require information and/or documentation related to a patient and/or member's health care treatment as a condition of payment of services. Generally, SCIO Health Analytics may disclose the PHI to:
- a third party, who may be responsible for injuries sustained by a member
- the insurance carrier or attorney representing the interest of the responsible third party
- an attorney representing the interest of the patient or member
- another insurance carrier who may have provided health benefits coverage to a patient or member
- a court of law or equity or to an administrative law judge, such as a Workers' Compensation judge; and
- the patient or member or to his/her spouse, parent, legal guardian or agent.
User acknowledges that patient information shall be used or disclosed by SCIO Health Analytics for purposes of payment, support, management or analysis functions. Payment has been defined by the privacy regulations to mean "Determination of eligibility of coverage (including coordination of benefits or determination of cost sharing amounts) adjudication on subrogation of health benefit claims, as well as billing, claims management, collection activities, obtaining payment under contract for reinsurance (including stop loss insurance and excess loss insurance), and related health care data processing."
